Inquest Hearing into death of struggle in 2014 concluded a year later

"The inquest into the death of Ndatipo (26) came to an end with a finding by Judge Christie Liebenberg that the identity of the person who fired the shot that killed her could not be established on the basis of the evidence available to him."
You can read more HERE

In light of the complete incompetence of the Namibian Police force, this result of the inquest hearing comes as no surprise. They are quick to produce all sorts of evidence when they have a personal vendetta against someone, but when it comes to proper investigations, they fail hopelessly. At least Judge Liebenberg did point out that "the police officers at the scene were not properly prepared and trained, and a specialised unit like the police's Special Reserve Force should have been dispatched to the scene to deal with the situation, he indicated. "

Yet this ruling does not differ a yota from the ruling given previously.
Begs the question:Who is being protected here?

The public outcry: Justice has not prevailed.

Law an order falls by the wayside in Namibia.

Today, Sunday 12/o7/2015 From the AR group."HAPPENING NOW: While they thought we are joking 300 of our Fearless People Just occupied land now in Windhoek. The Police Officers who came to the place did not act against our people, Instead they also started Occupying Land. Congratulations to Police Brothers who refused to be used and occupied the Land while their Top Brass Bosses are in Otjiwarongo planning for the 31 July 2015. This is our country too do not take us for granted! Respect us! Now let meaningful dialogue begin!"

When the police, who are supposed to uphold law and order, start siding with people who brake the law of the land, we have a problem.

New Era Newspaper has a slightly different version, claiming the two law enforcement units are asking for reinforcements.

An unkown gun announced the end of Namibian democracy

What a farce of an investigation!
What utter incompetence of the Namibian Police force.
On the first day of the inquest hearing into the death of Frieda Ndatipo, Judge Liebenberg heard that the gun could not be identified during the initial investigations last year.

The Namibian public is more than disgusted by the testimony given on the first day of this hearing.
THE gun from which the shot that killed the late Frieda Ndatipo was fired, could not be identified during the investigation of Ndatipo's death. - See more at: http://www.namibian.com.na/indexx.php?id=28928&page_type=story_detail#sthash.7kEftlGT.dpuf

Namibian MP's need lectures on Etiquette

This is a disgrace and an embarrassment for the SWAPO party and the whole Nation. As a Namibian I am ashamed to the bone to read THIS.

How on earth can people be elected as Parliamentarians when they don't have the faintest clue about how to behave in public. Etiquette is something one needs to be taught at home and if not there, then at least at school. Definitely NOT when being elected as an MP. That is a waste of public funds.

A person who does not know how to behave in public will constantly be an embarrassment, especially when such a person has to represent Namibia overseas. SWAPO should test it's people before electing them as MP's, not afterward.

UPDATE: The Lethal Shot that announced the End of Democracy in Namibia

On 27 August 2014 Frieda Ndatipo was shot dead when a group of protesters clashed with police officers in front of Swapo head  office in Windhoek. You can read more about that and watch the video HERE
After a public outcry then Prime Minister Dr. Hage Geingob instructed the Ombudsman to carry out an impartial investigation into the incident. The Ombudsman's report was handed to Justice Minister Albert Kawana in December 2014. It was not made public.
It took another 4 months before prosecutor general Martha Imalwa decided NOT to prosecute anyone in this case.

Now Minister Kawana has requested an inquest to be held, as we are told HERE

The very fact that a)it took 7 months to come to the decision of b)NO prosecution proves that something is very wrong here.

Allowing the police to carry and use live ammunition on their own initiative is a violation of Article 6 of the Namibian Constitution, which forbids the death penalty and executions.   Allowing them to open fire at demonstrators once again violates Article 17.

The decision of the prosecutor general to NOT prosecute anyone in this case is either a sign of gross incompetence or an acknowledgement of the fact that we now live in a police state.

Update on courtcase against Daycare owner Belinda //Garoës

In 2013 Belinda //Garoës, owner of a daycare center for poor children in a suburb of Okahandja, Namibia, was incarcerated on several criminal charges following an eviction order. Read more about that in "City Councils Vendetta against owner of Day-Care center in Okahandja" and here about my day in court with her.

I somehow lost contact with Belinda after that day until 14th February 2015, when she suddenly turned up again, telling me about the pending trial date on Monday, 16th February. This time she showed me the stack of documents she had received - transcriptions of all previous hearings.
While going through those transcripts I found the one pertaining to the trial date, which was eventually set for 16 February 2015 in a hearing in August 2014. Right up until that time she had not received any disclosure documents. In the August hearing the magistrate ordered that she had a right to those documents and that she should apply to receive them. When i asked her about that, she told me she had followed the order and personally handed in the application, without making a copy of it, however.  Oops, a grave mistake.

When I asked her for the disclosure documents, she pointed to the documents in my hand, telling me that is what she received on February 13 at the court offices.  Oh poor woman! But how was she to know? So her only option was to once again ask for the disclosure documents at the start of Mondays proceedings.

Well, today during lunchtime Belinda came to report about the proceedings. Apparently the prosecutor, right at the start of the  hearing, told the magistrate that she hadn't yet handed out the disclosure documents to Belinda, but would do so at 16h00. So the trial date was once again postponed to the 4th of June 2015 and Belinda is as happy as can come.

I haven't yet heard if she did in fact receive disclosure today. Will post another update if and when I hear from the lady again.

Update 17/2/2015: She did not get the disclosure documents yesterday because they now charge for those(illegally as I found out), and she of course had no money to pay for them.
